GENERAL TERMS AND CONDITIONS OF CONTRACT
https://stage.bigliettidelpantheon.com
This document governs the general terms and conditions applicable to the services offered through the website https://bigliettidelpantheon.com (hereinafter, the "Website"), owned by:
The Website is an independent booking management and intermediary platform and is not the official website of the Pantheon of Rome or of the entity responsible for its management.
BeTraveller OÜ offers, through the Website, intermediary and booking management services for access to tourist attractions, as well as its own complementary services related to the User's experience.
These complementary services may include, among others, personalised assistance, customer support, booking management and digital informational content or guides.
BeTraveller OÜ is not the operator of the Pantheon of Rome and does not directly provide admission to the monument. Final admission is provided by the corresponding entity or provider.
These terms govern the contractual relationship between BeTraveller OÜ and users who make a purchase or booking through the Website (hereinafter, the "User").
Before completing the transaction, the User must read and expressly accept these Terms and Conditions. Completing the purchase constitutes acceptance thereof.
4.1 Booking
To make a booking, the User must select the available options and provide truthful, complete and up-to-date information. Creating an account is not required.
The User is responsible for checking, before making payment, that the date, time, number and category of visitors and all other booking details are correct.
4.2 Payment
Payment will be made using the methods enabled on the Website and may be processed by specialised payment service providers. BeTraveller OÜ does not store the User's complete bank card details when these are processed directly by the payment provider.
Once payment has been confirmed, the booking will be processed and the User will receive the corresponding documentation by email, which may include confirmations, tickets, QR codes, booking references and access instructions.
The time required to process a booking may vary depending on availability and the provider's procedures.
If the User does not receive the corresponding documentation within the period indicated during the purchase process or, in the absence of a specific period, within 24 hours, the User should contact customer support.
6.1 Total price
Before completing the purchase, the User will be able to review the total price applicable to the booking. The amount displayed on the Website may include both the cost associated with admission provided by third parties and the remuneration corresponding to BeTraveller OÜ's own intermediary, management and assistance services.
6.2 Complementary services
Depending on the option purchased, the service may include additional features such as:
The total price and essential characteristics of the service will be shown to the User before payment is confirmed.
6.3 Invoicing
The User may request an invoice by providing the necessary tax information through the channels made available by BeTraveller OÜ.
BeTraveller OÜ may establish reasonable limits on the number of bookings or tickets and apply controls intended to prevent fraudulent or abusive transactions.
It is prohibited to use the Website or contracted services for fraudulent activities, deliberately provide false information or engage in any other use contrary to applicable law.
Where there are reasonable indications of fraud, unlawful use or contractual breach, BeTraveller OÜ may suspend processing while carrying out the necessary checks and, where appropriate, cancel the booking and issue any refund required by law or contract.
As a general rule, European law grants consumers a right of withdrawal for certain distance contracts. However, this right is subject to statutory exceptions.
In particular, the right of withdrawal may not apply to services related to leisure activities where the contract provides for a specific date or period of performance, in accordance with applicable consumer protection law.
Likewise, certain digital services or services whose performance has begun at the User's express request may be subject to specific rules concerning the right of withdrawal.
The cancellation conditions applicable to each booking will be those communicated to the User before completion of the purchase and those set out in these terms.
The possibility of cancellation, modification or refund will depend on the processing status of the booking, the conditions communicated before purchase and, where applicable, the conditions imposed by the provider.
As a general rule:
The User must carefully check their booking details before making payment.
Where the User requests cancellation or modification due to an error in the date, time, category, number of visitors or other information entered during the purchase, BeTraveller OÜ will attempt to accommodate the request provided that the booking can still be modified.
If the tickets have not yet been processed and cancellation is possible, the corresponding refund may be issued, with management expenses or costs actually incurred being deductible where the User has been informed of this and where permitted by applicable law.
Once a ticket has been processed, no modification or refund can be guaranteed.
For the purposes of these terms, a ticket may be considered processed once it has been purchased, issued, confirmed, reserved or communicated to the corresponding provider in order to fulfil the User's request.
From that moment, any modification, cancellation or refund will depend on the applicable conditions and the actual possibility of modifying or recovering the ticket.
Admission to the monument and certain components of the booking may be provided by third parties independent of BeTraveller OÜ.
Access rules, security checks, actual opening hours, extraordinary closures, dress requirements, restrictions and other operational conditions established by the monument or corresponding provider must be observed by the User.
BeTraveller OÜ does not control operational decisions made directly by such third parties.
BeTraveller OÜ will not be liable for failures or delays resulting from events reasonably beyond its control, including, among others, natural disasters, conflicts, health emergencies, strikes, decisions by public authorities, extraordinary monument closures, widespread infrastructure failures or equivalent circumstances.
Where such circumstances affect a booking, BeTraveller OÜ will inform the User as soon as reasonably possible and manage the available alternatives in accordance with the applicable conditions and consumer rights.
For operational, security or availability reasons, or due to decisions by the provider, changes may occur to schedules, access arrangements or other characteristics of the visit.
Where a substantial change affects an essential element of the contracted service, BeTraveller OÜ will inform the User and, where appropriate, offer a reasonable alternative, rescheduling or refund in accordance with applicable law and conditions.
BeTraveller OÜ will be responsible for the intermediary, management and assistance services it provides directly in accordance with these terms and applicable law.
Without prejudice to the rights legally granted to consumers, BeTraveller OÜ will not be responsible for events exclusively attributable to external providers or operators, such as operational changes, closures, security checks or incidents occurring during the visit that are outside its reasonable control.
Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot legally be excluded or limited.
The User may make enquiries, request assistance or submit complaints through the contact channels provided on the Website.
BeTraveller OÜ will endeavour to handle booking-related communications diligently and provide a solution where appropriate.
The User's personal data will be processed in accordance with applicable data protection law, including Regulation (EU) 2016/679 (General Data Protection Regulation or GDPR).
Information concerning the purposes of processing, legal bases, recipients, data retention and the exercise of rights is available in the Website's Privacy Policy.
These terms will be governed by the laws of the Republic of Estonia, without prejudice to mandatory consumer protection provisions applicable to the User that cannot be excluded by contractual agreement.
Any dispute may be submitted to the competent courts in accordance with the applicable rules on jurisdiction.
Where applicable, the User may also use consumer alternative dispute resolution mechanisms available under current law.
These Terms and Conditions may be available in several languages to facilitate understanding by users.
In the event of any discrepancy between translations, the Spanish version will be used as the reference version, without prejudice to any rights granted to consumers by applicable law.
A No-Show occurs when the User fails to attend the relevant location within the date and time slot established for the booking.
Unless the specific booking conditions or applicable law provide otherwise, failure to attend will not entitle the User to a refund, modification, rescheduling or compensation.
The User is responsible for allowing sufficient time to travel to the monument and complete the corresponding access checks.
If the User believes that there is an error relating to a charge, booking or refund, they are encouraged to contact BeTraveller OÜ first in order to attempt to resolve the matter directly.
The legitimate exercise of the User's rights vis-à-vis their financial institution is not restricted by these terms.
Where a payment dispute or chargeback is initiated, BeTraveller OÜ may provide the payment service provider or financial institution with the documentation necessary to substantiate the transaction, including, where appropriate, booking confirmation, delivery documentation, communications with the User and evidence of the services provided.
Deliberate attempts to obtain a fraudulent refund for services properly provided may result in reasonable measures being taken to prevent further fraudulent transactions and, where appropriate, the exercise of legally available remedies.
